The Presidential Decree ("Decree") numbered 3592 was published in the Official Gazette dated March 9, 2021 and numbered 31418. In accordance with the Decree the prohibition of termination and unpaid leave periods are extended for a period of two months. Accordingly, the periods previously extended until March 17, 2021 will be applicable until May 17, 2021 with the new update.
Accordingly; except for situations that do not comply with the moral and good faith rules contained in paragraph (II) of Article 25 of the Labor Code and the relevant provisions of other laws, the expiration of the period in certain term employment or service contracts, the closure and operation of the workplace for any reason, any service purchases made in accordance with the relevant legislation and the termination of the work in the construction works, employment or service contracts will not be terminated by employers until May 17, 2021.
In addition, the employers can provide unilateral unpaid leave without the employee’s consent, in whole or in part, until 17/5/2021.
